Two weeks ago on CNN, I made a simple point about the president's executive order on elections. It assumes Washington can tell who is a citizen and who isn't. It can't. This country has never had a complete, reliable list of its citizens.
On Friday, the Supreme Court weighed in. Separately, earlier this month, the justices kept blocking a plan to have the Postal Service screen mail ballots against a federal roster. That's off for November.
Friday's case involved SAVE, a Homeland Security database once limited to checking noncitizens' eligibility for benefits. Last year the administration linked it to Social Security's master file, covering more than 300 million people, so states can run voter rolls through it. A federal judge blocked that in June. Thirty-nine days before the midterms, the Court put her ruling on hold.
Notice what the justices answered: whether the government may do this. Not whether it works. Social Security's file is a list of numbers, not citizens. Someone who got a card and later became a citizen can still show up as a noncitizen. The government's own records say its citizenship data "might not be current." In Travis County, Texas, a quarter of those flagged had already proven citizenship.
Federal law bars mass purges this close to an election, so November's impact may be modest. But some citizens will get letters asking them to prove what they already are.
The Court said the government may check. It didn't say the government knows the answer.
There is still no reliable list.
